Mayor Says Sidewalk Ordinance Might Need Review

MADISON, Wis. -- A Madison homeowner who said he didn't deserve a sidewalk snow ticket from the city of Madison has won his battle.
TALKBACK: What Do You Think?The city's chief building inspector has dismissed Chris Brady's ticket and apologized.Brady said he is relieved that the whole thing is over.Last week, WISC-TV and Channel 3000 reported on the piece of ice on Brady's otherwise clear sidewalk that netted him a $109 ticket.Last Friday, Madison's mayor said that Brady didn't deserve the ticket. And on Tuesday, the head of building inspection told Brady the ticket would be dismissed because much of his sidewalk had been cleared.Brady said the mayor told him that giving people a warning first would be best."(The mayor) wants to amend the law to change the law so that you get a warning first, and I would ask that everyone in Madison support him in that effort because it would be a shame if we run into this exact same thing again next winter and the winter after that. I think it there's one thing myself, inspectors and the government all agree on is the current law is unworkable," Brady said.Chief Building Inspector George Hank wrote to Brady saying that his staff issued 1,400 sidewalk tickets but got 2,000, and that proves inspectors do use discretion.Hank wrote to Brady in an e-mail: "This has been a hard year for everyone. Staff here and physically and mentally exhausted. The number of complaints continues to stay at an unprecedented rate. As a result, I asked staff to reserve tickets for the cases I describe as 'no brainers.'"
